1. Introduction

Welcome to Decantio.eu (hereinafter referred to as “the Platform”, “we”, “us”, or “our”). Decantio.eu is an online marketplace and directory that enables registered users to list, buy, and sell perfume decants sourced from private collections.

By accessing or using the Platform, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the Platform. These Terms apply to all visitors, users, buyers, and sellers (collectively referred to as “Users”).

Decantio.eu operates as a neutral intermediary and does not itself buy, sell, or handle any products listed on the Platform.

2. Definitions

“Platform” means the website Decantio.eu and all associated services.
“User” means any individual who accesses or registers on the Platform, whether as a buyer, seller, or visitor.
“Seller” means a registered User who lists perfume decants for sale on the Platform.
“Buyer” means a registered User who purchases or attempts to purchase a decant from a Seller.
“Listing” means any product advertised for sale on the Platform by a Seller.
“Decant” means a portion of a fragrance transferred from an original bottle into a smaller container for the purpose of sampling or selling.
“Transaction” means any completed or attempted sale or purchase between a Buyer and a Seller via the Platform.
“Platform Administrator” or “Admin” means any authorised member of the Decantio.eu team responsible for managing and moderating the Platform.

3. Nature of the Platform — Intermediary Status

Decantio.eu operates solely as a neutral online marketplace and listing directory. The Platform does not manufacture, store, inspect, ship, purchase, or sell any products listed by Users.

All Transactions occur directly between Buyers and Sellers. Decantio.eu is not a party to any Transaction and assumes no liability in connection with any Transaction conducted through the Platform.

The Platform does not endorse any Seller, Listing, or product. Any information provided in a Listing is the sole responsibility of the Seller who created it.

4. Seller Responsibilities and Obligations

4.1 Product Authenticity

Sellers bear full and sole responsibility for the authenticity of all products listed. By creating a Listing, Sellers confirm that:

The fragrance decanted originates from an authentic, legally obtained bottle.
The product is not counterfeit, imitation, or misrepresented.
The images uploaded to the Listing accurately represent the actual product being sold.

Decantio.eu does not verify, inspect, or guarantee the authenticity of any product and expressly disclaims all liability in this regard.

4.2 Legal Compliance and Labeling

Sellers are solely responsible for ensuring their activities comply with all applicable laws and regulations, including but not limited to:

EU Cosmetics Regulation (EC) No 1223/2009 regarding labeling, safety, and composition of cosmetic products.
REACH Regulation (EC) No 1907/2006 regarding chemical substances.
Applicable consumer protection legislation in the Seller’s country of residence.
Any national laws governing the private resale of cosmetic products.

Decantio.eu accepts no liability for Sellers’ failure to comply with applicable legal requirements.

4.3 Shipping and Delivery

Sellers are solely responsible for all aspects of shipping and delivery, including:

Packaging decants safely and in compliance with carrier and customs requirements.
Accurately stating shipping costs, destinations, and estimated delivery times.
Compliance with international shipping regulations for liquids and cosmetics.
Any customs duties, import taxes, or regulatory requirements applicable to cross-border shipments.

Decantio.eu is not liable for lost, damaged, delayed, or confiscated shipments under any circumstances.

4.4 Pricing and Accuracy

Sellers set their own prices and are responsible for the accuracy of all information in their Listings, including fragrance name, concentration, volume, condition, and any other attributes. Misleading or fraudulent Listings are strictly prohibited and may result in account suspension.

4.5 Images and Content

Sellers retain responsibility for all images, descriptions, and content uploaded to the Platform. By uploading content, Sellers confirm they hold the rights to use such content and that it is accurate, lawful, and not misleading. Decantio.eu does not verify uploaded images and is not liable for inaccurate or misleading visual representations.

5. Buyer Responsibilities

Buyers acknowledge and accept the following:

All Transactions are conducted directly with Sellers. The Platform is not a party to any purchase agreement.
The Platform does not guarantee the authenticity, quality, safety, or condition of any product listed.
Buyers are responsible for conducting their own due diligence before completing a purchase.
Any disputes regarding products, delivery, or refunds must be resolved directly with the Seller in the first instance.
By completing a purchase on the Platform, Buyers confirm they have read and accepted these Terms.

Buyers are advised to review Seller ratings, reviews, and listing details carefully before purchasing.

6. Platform Fees and Payments

Decantio.eu may charge fees in connection with Transactions made through the Platform. These may include, but are not limited to, listing fees, transaction fees, or commission charges.

Any applicable fees will be communicated to Users prior to the completion of a Transaction. The Platform reserves the right to introduce, modify, or remove fees at any time, with reasonable prior notice provided to Users where required by applicable law.

Decantio.eu is not responsible for payment disputes between Buyers and Sellers. Payment processing may be handled by third-party providers, and their respective terms and conditions apply.

7. Platform Moderation and Administrator Actions

Decantio.eu Platform Administrators are not proactively responsible for monitoring, reviewing, or moderating all content, Listings, or User activity on the Platform on an ongoing basis. The Platform operates as a passive hosting service and relies on Users to maintain the integrity of the marketplace.

7.1 Request-Based Moderation

Platform Administrators will only take action in response to formal requests or complaints submitted by Users through the official complaints process. Actions taken by Administrators are therefore reactive in nature and not proactive. The Platform does not guarantee that all submitted requests will result in a specific action or outcome.

To submit a request or complaint, Users must contact the Platform at support@decantio.eu, providing sufficient detail to allow the Administrator to assess the situation. Anonymous reports or complaints lacking sufficient information may not be actioned.

7.2 Actions Available to Administrators

Upon receiving and reviewing a valid User request or complaint, Platform Administrators may, at their sole discretion, take any of the following actions:

Remove or suspend a Listing that is found to violate these Terms.
Issue a formal warning to a User whose conduct is in breach of these Terms.
Temporarily suspend a User account pending investigation of a complaint.
Permanently terminate a User account in cases of serious or repeated violations.
Request additional information from the parties involved before taking action.
Decline to act where a complaint is found to be unsubstantiated, outside the Platform’s scope, or submitted in bad faith.

7.3 Limitations of Administrator Actions

Platform Administrators are not arbitrators, mediators, or legal authorities. Any action taken by an Administrator is limited to the Platform environment and does not constitute a legal determination of any dispute between Users. Administrators cannot compel Sellers to issue refunds, verify the authenticity of products, or intervene in shipping and delivery matters.

Users retain full responsibility for resolving commercial and legal disputes directly between themselves. Where no resolution is possible, Users are encouraged to seek independent legal advice or use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr

7.4 Response Timeframes

The Platform will endeavour to acknowledge complaints within a reasonable timeframe. However, no guaranteed response time is provided, and the volume and complexity of complaints may affect processing times. The Platform accepts no liability for any loss arising from delays in responding to or acting upon complaints.

8. Disclaimer of Liability

To the fullest extent permitted by applicable EU and national law, Decantio.eu expressly disclaims all liability for:

The authenticity, originality, quality, safety, or fitness for purpose of any product listed on the Platform.
Any damage, loss, or injury arising from the use of a product purchased through the Platform.
Loss or damage during shipping, customs delays, or non-delivery of products.
The accuracy of Listing information, including images, descriptions, and fragrance attributes.
Disputes between Buyers and Sellers, including payment disputes, refund claims, or fraud.
Any financial loss arising from Transactions conducted through the Platform.
Any delay, failure, or outcome of the Platform’s complaints or moderation process.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under EU law.

9. User Accounts and Registration

By creating a profile on Decantio.eu, Users agree to:

Provide accurate, complete, and up-to-date information at the time of registration and thereafter.
Take full responsibility for all information shared on the Platform, including profile details, Listings, and communications.
Maintain the confidentiality of their account credentials and notify the Platform immediately of any suspected unauthorized access.
Not create accounts using false identities or on behalf of third parties without authorization.

Decantio.eu reserves the right to suspend or terminate any account found to be in breach of these Terms, without prior notice where circumstances require.

10. Data Protection and GDPR Compliance

Decantio.eu is committed to protecting User personal data in compliance with Regulation (EU) 2016/679 (the General Data Protection Regulation, “GDPR”) and applicable national data protection laws.

10.1 Data Consent

By creating a profile and using the Platform, Users explicitly consent to the collection, storage, and processing of their personal data by Decantio.eu for the purposes of:

Operating and maintaining User accounts.
Facilitating Transactions between Buyers and Sellers.
Improving Platform functionality and user experience.
Communicating with Users regarding their account and Platform updates.
Complying with legal obligations.

10.2 User Rights

Under GDPR, Users have the following rights regarding their personal data:

Right of access — to request a copy of personal data held by the Platform.
Right to rectification — to request correction of inaccurate data.
Right to erasure — to request deletion of personal data, subject to legal retention obligations.
Right to data portability — to receive personal data in a structured, machine-readable format.
Right to object — to object to certain types of data processing.
Right to withdraw consent — at any time, without affecting the lawfulness of prior processing.

10.3 Data Retention and Security

Personal data is retained only for as long as necessary for the purposes for which it was collected, or as required by applicable law. The Platform implements appropriate technical and organisational measures to protect personal data against unauthorized access, loss, or disclosure.

11. Prohibited Activities

Users must not use the Platform to:

List, sell, or promote counterfeit, stolen, or otherwise illegally obtained fragrances.
Misrepresent the identity, concentration, volume, or condition of any product.
Upload false, misleading, or infringing images or content.
Engage in fraudulent Transactions or payment manipulation.
Harass, abuse, or threaten other Users.
Violate any applicable local, national, or EU law or regulation.
Attempt to circumvent Platform fees or payment systems.
Submit false, malicious, or bad-faith complaints against other Users.

Violations may result in immediate account suspension, removal of Listings, and where appropriate, reporting to relevant authorities.

12. Intellectual Property

All intellectual property rights in the Platform, including its design, software, text, graphics, and branding, are owned by or licensed to Decantio.eu. Users may not reproduce, distribute, or create derivative works from Platform content without prior written permission.

Users retain ownership of content they upload, including Listing images and descriptions. By uploading content, Users grant Decantio.eu a non-exclusive, royalty-free, worldwide licence to use, display, and distribute such content for the purposes of operating the Platform.

13. Modifications to These Terms

Decantio.eu reserves the right to modify these Terms at any time. Users will be notified of material changes via email or a prominent notice on the Platform. Continued use of the Platform following notification constitutes acceptance of the updated Terms.

Where required by applicable law, Users will be given a reasonable period to review changes before they take effect.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of Spain, where the Platform operator is based.

In the event of a dispute, Users are encouraged to first attempt resolution through the Platform’s complaints process by contacting support@decantio.eu. If a resolution cannot be reached, Users in the EU may also have access to the European Commission’s Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr

Nothing in these Terms affects Users’ statutory rights as consumers under applicable EU consumer protection law.
